1. General Disclaimer

By booking a session with Camera & Heart, clients acknowledge and agree to the following terms.

2. Liability & Responsibility

Camera & Heart is not responsible for:
   - Unforeseen circumstances (e.g., weather, venue restrictions, client delays) that affect the session outcome.
   - Lost, stolen, or damaged personal property during a shoot.
   - Client dissatisfaction due to factors outside our control, such as attire, makeup, or expressions.
   - Unauthorized third-party use of delivered images.
   In the event of technical failures (e.g., equipment malfunction, data loss), Camera & Heart reserves the right to reschedule the session or provide an alternative solution.

3. Copyright & Image Usage

All photographs remain the copyright of Camera & Heart. Clients receive a license for personal and/or commercial use as agreed upon in their contract. Unauthorized resale, modification, or distribution of images without written permission is prohibited.

4. Model Release & Privacy

By booking a session, the client grants Camera & Heart permission to use images for marketing, portfolio, and promotional purposes unless otherwise agreed upon in writing. Clients may request in advance that their images remain private.

5. Payment, Cancellations, & Refunds

- A non-refundable deposit of 80% is required to secure your session. The remaining balance is due on or before the session date and must be paid via Zelle, PayPal, online payment through the website, or Cash App.
   - If the final balance is not paid by the session date, a $25 late fee will be applied. If the balance remains unpaid 24 hours after the session date, the session may be canceled, and the deposit will not be refunded.
   - Rescheduling requests must be made at least 4 hours before the scheduled session and are subject to availability.
     - One complimentary reschedule is allowed.
     - Additional reschedules will incur a $50 rescheduling fee per change.
   - Bounced payments or chargebacks (e.g., reversed PayPal or Zelle transactions) will incur a $35 fee in addition to the unpaid balance. The session will not proceed until the payment is successfully cleared.
   - Refund Policy for Canceled Sessions:
     - Client Cancellations:
       - If the client cancels at least 7 days before the scheduled session, a partial refund (20% of the total session cost) may be issued at the photographer’s discretion.
       - If the client cancels less than 7 days before the session, the deposit is non-refundable, but a reschedule may be offered based on availability.
     - Photographer Cancellations:
       - If Camera & Heart cancels the session due to illness, an emergency, or unforeseen circumstances, the client will be offered either a full refund or the option to reschedule at no additional cost.
   - No refunds will be issued for completed sessions.

6. Editing & Delivery Timeline

- Final edited images will typically be delivered within 3-4 weeks (business days). However, delivery times may vary depending on the scope of the project, seasonal demand, or unforeseen circumstances.
   - If additional time is needed, clients will be notified promptly with an updated delivery estimate.
   - Expedited delivery may be available for an additional fee upon request.

7. Force Majeure

Camera & Heart is not liable for cancellations, delays, or the inability to fulfill a session due to circumstances beyond our control, including but not limited to natural disasters, extreme weather conditions, illness, accidents, power outages, government restrictions, or other unforeseen emergencies.
   In such cases, every effort will be made to reschedule the session at a mutually convenient time. If rescheduling is not possible, a fair resolution, such as a partial refund or credit toward a future session, may be offered at the photographer’s discretion.

8. Agreement & Acknowledgment

By booking a session with Camera & Heart, the client confirms they have read, understood, and agreed to these terms.
   A signed contract may be required for certain services, and clients are encouraged to review all policies before finalizing their booking.
